Medicare, Medicaid and SCHIP Act

The Medicare, Medicaid and SCHIP (MMSEA) legislation passed in 2007 requires reporting of claims data to Medicare on a timely basis. There is a $1,000 per day per claim penalty for failure to report in a timely manner and in the format set out by Medicare. Medicare will use this data to verify carriers’ and self-insureds’ compliance to the Medicare Secondary Payer (MSP) act.
